Mum to make accident claim after playground injury
A mum has threatened to make an accident claim against a Scottish primary school after her son broke his collar bone on a playground climbing frame.
Julie Gardner is planning to make the compensation claim against Edinburgh City Council following the incident at Clovenstone Primary on 6th September 2005 .
She alleges that seven-year-old James was playing underneath a climbing frame during morning breaktime when three girls tumbled from above, knocking him into a wooden beam and causing his personal injury.
The 35-year-old mother of three has warned that if a settlement is not agreed she will take both the council and the school to court and make an accident claim. Speaking from her Edinburgh home, Ms Gardner said, "I've spoken to my lawyer and I am taking legal advice.
"I'm not happy about their response to the accident or the supervision that James was given."
In response, a council spokeswoman issued a statement declaring, "The matter is subject to a public liability insurance claim and is being dealt with by council insurers."
