People making injury claims to the Personal Injury Assessment Board (PIAB) in Ireland are losing out because they lack the appropriate legal knowledge, claims John Carty, a solicitor at Kent Carty Solicitors.
People wishing to make a personal injury claim must write to the PIAB explaining the legal reason for the compensation claim, but many fail to do this correctly. Mr Carty comments that 5,000 of 13,800 injury claim forms that the PIAB receives are incomplete due to claimants not having enough awareness of legal issues.
An additional problem is that the PIAB does not offer compensation for legal fees and costs, so if people do seek help from their solicitors, it is at their own expense. Mr Carty said: “The problem, therefore, is that the award has to be large enough to allow claimants to pay for legal costs. For even a simple case, the legal bill is rarely less than €2,000 (£1,368).”
