Group action against tobacco firms
A no win, no fee group action has begun against tobacco firms Imperial Tobacco and Gallahers by people suffering from lung cancer or families of people who have died from the disease.
The Legal Aid Board had been funding an investigation into lung cancer personal injury claims, but withdrew in July 2005. A no win, no fee agreement has now been offered by Leigh, Day and Co, and 40 claimants are involved in the group action.
If the group action is successful, it could allow many of the 38,000 people diagnosed with lung cancer each year to start similar personal injury claims. It is estimated that each claimant could be awarded up to £50,000 in compensation, resulting in the tobacco companies having to pay many millions of pounds.
There is high risk with the personal injury claim, however, with a £3 million loss for Leigh, Day and Co if the case is unsuccessful. However, Martyn Day, a partner at the firm, is confident, saying: “I was of the view before the [Legal Aid] Board’s decision that the claims are strong – I am still of that view.”
