£5m compensation for air crash

A fatal accident claim resulted in £5m in compensation being awarded to the family of Hugh Paton, who died when his aircraft crashed.

The crash happened when Mr Paton was flying in Cornwall with his wife and two daughters on board. The family claimed that a Ministry of Defence aircraft was manoeuvring too close to a runway just as Mr Paton was about to land. Mr Paton, the pilot, swerved to avoid it but the aircraft became unstable, and he suffered serious personal injuries which he later died from.

An out of Court settlement of £5 million was agreed, thought to be the largest amount of compensation awarded in a case of this type. However, the settlement was only reached the day before the fatal accident claim was due to be heard in the High Court.

Mr Chamberlayne, representing the Paton family, commented: “The settlement is a testimony to Hugh Paton. His loss remains a tragedy for his family but at last, after having to fight their case all the way to the doors of the Court, they have achieved a record settlement.”
