Airlines will no longer have to pay compensation to people with DVT

A house of Lords of decision has now exonerated airlines from paying accident compensation to people suffering from deep vein thrombosis (DVT) after flying with them. The ruling has signalled an end to people pursuing a compensation claim of this kind and other similar claims. The House of Lords decision was made on the basis that the onset of DVT caused by air travel does not meet the definition of an accident under the Warsaw Convention (which governs airline regulations) and therefore cannot be the basis for a personal injury compensation claim.

According to the results of the case ‘The definition of an accident in terms of air travel relates to an event or happening, which was more than the normal operation the aircraft and external to the passenger’.
