The Association of Personal Injury Lawyers (APIL) are adamant that people suffering from pleural plaques should be able to make personal injury claims, and have criticised insurers who have been fighting to deny pleural plaques compensation to claimants.
The Court of Appeal has heard insurers claim that because sufferers do not have any physical symptoms, they should not receive personal injury compensation. However, personal injury solicitors argue that someone with pleural plaques should be able to make a personal injury claim because the condition can mean an increased risk of developing a more serious asbestos-related disease, and as such causes a great deal of worry.
The vice president of APIL, Richard Langton, commented: “When these cases were heard last year, we said it was nothing more than a greedy and shameless attempt by insurers to save yet more money at the expense of injured people.
“People diagnosed with pleural plaques have suffered physical damage because of exposure to asbestos, and are playing a waiting game to see whether they go on to develop a disease which could kill them.”
