Personal injury news
18 months before a claims watchdog comes to fruition
Although a new compensation Bill has been published it still may be 18 months before a regulatory body is established. The Lord Chancellor of the Department of Constitutional Affairs, (DCA) Lord Falconer has implied that the front runner for the role may be the Claims Standards Council (CSC). An independent expert has been commissioned to examine the credentials of the CSC.
Since the Bill has been published early reports suggest that the rogue operators and claims farmers are giving up their membership to the CSC and many new firms are applying. Once the regulator is in place it will be law to be a member and to abide by the code of practise that it decrees. The public will be able to make a personal injury claim following a car accident, accident at work or any situation where they were injured as a result of someone else’s negligence, safe in the knowledge that they are using the services of a fully regulated and therefore reputable firm.
An investigation is under way by the Constitutional Affairs Committee into “compensation culture” and many firms will be scrutinised. Once regulation is in place, disreputable practises and unethical standards will be a thing of the past.
