Around 15% of motorbike crashes involve a rider losing control while going round a bend, corner or curve. Unfortunately though, riders are unlikely to be able to make a motorcycle accident claim for such an incident as, usually, they are considered the sole fault of the rider.
Indeed, a definitive 1981 study showed that this type of accident is usually caused by "slideout and fall due to overbraking, running wide of a curve due to excess speed, or undercornering".
Furthermore, it has also been found that riders most likely to be involved in this type of accident are usually so-called "pleasure riders" (those who ride as a hobby) or those who are inexperienced.
Inexperienced riders can fall into one of three categories: those who have only recently received their motorcycling license; those "born again" riders who have returned to two-wheeled motoring after a break of ten years or so, or; provisional license riders, who have a higher than average rate for this type of accident.
Despite the fact that it is not usually possible to claim compensation for this type of crash, there are some cases where it may be possible to make a motorcycle accident claim for a bend, corner or curve accident. For example, where the road surface is unusually hazardous, perhaps because of oil, mud, gravel or potholes, it may be possible to find another party liable. Another example would be where a pillion passenger sustains injury as a result of the reckless riding of a motorcyclist.
A spokesperson from no win, no fee claim specialist YouClaim comments, "The vast majority of single-vehicle bend, curve or corner accidents have only the motorcyclist to blame. However, in instances where a topographical road factor may be the cause, an injured rider would be well-advised to consult a personal injury lawyer about his chances of claiming compensation."
