The presiding judge, however, ruled that the motorbike rider had been driving too fast before the incident occurred and only had himself to blame for his injuries.

Speaking in relation to the case, Judge Richard Seymour QC said, "The sole cause of the injuries [the claimant] sustained in the accident on June 15, 2006 was his driving his motorcycle at a speed so fast that it was unable to stop and avoid the collisions with the tractor and the trailer."

He added that the motorbiker was driving in excess of the speed limit and was satisfied that the tractor driver was not to blame for the accident.
