Motorbike injury suffered on private land may merit compensation

In nearly every case of a motorbike injury, there is another vehicle involved in a collision with the machine and, often, it is the driver of this car, lorry, van or other form of transport who is found liable for causing the accident and whose insurers will be responsible for meeting a compensation claim.

However, there can be other people or organisations which could also be deemed liable for a motorcyclist coming off his or her bike and being hurt.

Travelling on two wheels rather than four brings the biker in much closer proximity with the road and a well-maintained surface, without potholes and debris, will improve the chances of him or her being able to brake safely if an emergency arises; however, the opposite scenario also applies.

A poorly-surfaced road, perhaps with standing water, bumps, loose stones or other obstacles will provide far more of a risk of a crash to a motorcyclist than it will to the driver or a car or other vehicle.

Responsibility for maintaining a standard trunk, urban or rural road usually lies with the local authority for any particular area of the UK. Motorways are under the control of the Highways Agency, which is a Government-funded organisation.

There are also a number of privately-owned and maintained roads which general traffic is allowed to use if the drivers or passengers have reason to call on the householders or businesses with frontages to those roads.

This can apply to industrial estates and sports centres as well as residential areas and if a motorcyclist should suffer an accident which could be attributed to the poor quality of the road surface or because obstructions made the tarmac or concrete dangerous then the owner of the land could be responsible for paying damages to a road accident victim, especially if no other vehicle was involved.

If a motorcycle or other vehicle is being used illegally on private land, the question of liability may be more complex.

Inadequate lighting or poor signage on private land could also increase the risk of personal injury to a motorcyclist because they may be unaware of a hazard and able to take evasive action.
