Pillion passenger can suffer more than rider in motorbike accident

For a variety of reasons, a pillion passenger is at more risk of injury in a motorbike accident than the rider himself and, should an accident occur, the rider as well as, or instead of, another vehicle driver could be liable for compensation to the victim.

If the rider is a partner, good friend or even a member of the victim's family, it may be hard to think of taking legal action to gain recompense from someone you love and with whom you wish to continue to have a relationship but that is your right under the law and it will not be the motorcyclist himself who will have to make a financial payment if the claim is agreed but the insurance company with which he has a policy.

Having compulsory vehicle insurance proves its worth when there is an accident and, although some drivers who are at fault might complain about losing their no-claims bonus and paying more for future policies, the lawyers who drafted the laws realised that it was in the best interests of all road users for the insurance laws to be quite stringent.

Falling from a motorcycle, even when going slowly, almost always causes some kind of injury and, again, the law-makers have had a hand in trying to protect people from themselves by forcing all riders and passengers on UK roads to wear suitable safety helmets.

Modern protective wear, including clothing to cover the arms and legs, can save lives and reduce the seriousness of injuries but, unfortunately, a lot of casualties from motorbike accidents result from people coming off the machines and hitting a hard object, either another vehicle or a roadside object such as a lamp-post or sign and there is little the victim can do to avoid doing so.

The passenger will often be more vulnerable than the rider in a crash because they have little or nothing to hold onto on the bike, whereas the rider will have the handlebars. Also, as with a car crash, the rider/driver will be quicker to anticipate the possibility of an accident and react accordingly, either by taking evasive action or holding on tighter, which a pillion rider may not be able to do.
