Making a motorcycle accident claim after being hit while stationary

Being involved in a road traffic accident in which you were injured and which was not your fault, can be painful, stressful and result in time spent off work, or in some cases, loss of your livelihood. In these cases, making a motorcycle accident claim may help you obtain the compensation you are entitled to.

The statistics
Using hospital admissions data, Department for Transport (DfT) figures show that in 2009 road accidents were to blame for 39,000 hospital admissions around the UK.

Motorcyclists are 26 times more likely to die in a road traffic accident than someone in a car and five times more likely to be injured.

Injuries sustained are usually to the motorcyclist's head, hips or legs and can be particularly serious, causing permanent disability in some cases.

It is not just reckless driving on the motorcyclist's part which can lead to these accidents.

Even safe riders can suffer motorbike injury and most often it is because of another road user. Worryingly, two-thirds of motorcycle accidents, which involve another road user, are caused because the car driver violated the motorcyclist's right of way.

These motorcyclists may be able to claim compensation because the accident was not their fault.

Injured whilst stationary
When visualising a motorcycle accident most people are likely to see fast moving vehicles, but strangely, some people sustain a motorcycle injury when completely stationary.

Occasionally, distracted drivers hit bikes in car-parks while attempting to park their cars. Luckily, most of the time, the motorcyclist is no longer on his bike when this happens, but other occasions, outside on the road, may see the motorbike rider seriously hurt.

Safe motorbike riders will stop at red lights, roundabouts and junctions, but the same cannot always be said for the car behind them.

In some cases, motorcyclists have been thrown off their bikes when crashed into by the car behind them, which was travelling too fast to stop, or whose driver had not noticed that the motorcyclist had come to a standstill.

The force of the collision is often enough to cause permanent injuries to the motorcyclist, even though they where upholding the Highway Code rules to keep themselves safe.

How to reduce the possibility of a road traffic accident
Safe motorcyclists may well see themselves as protected from a road traffic accident because of their careful driving, but as already shown, their driving safely does not mean that other road users are also driving safely.

There are ways of reducing the possibility of being hit by another driver.

  • Wearing bright clothing so that the rider stands out.
  • Having reflectors on clothes at night.
  • Wearing a white helmet. Studies have shown that these are most visible to other road users.
