Motorbike accident claims with YouClaim's specialist lawyers

Any motorcycle that is sold for use on public roads in the UK should be suitable and safe to ride – in fact, it is a legal requirement. But what if a bike does not meet UK requirements and then goes on to cause injury – can a motorbike accident claim be made against the seller?

Standards
A system of mandatory European Community Whole Vehicle Type Approval (ECWVTA) has been in force for motorcycles for decades.

EC Whole Vehicle Type Approval (ECWVTA) is framed around EC Directives and ensures the approval of whole vehicles, as well as such things as vehicle systems and individual components. The certification applies EU-wide without the need for further testing of individual bikes, provided that the manufacturer provides a Certificate of Conformity declaring that the bike for sale is the same as the one which passed the ECWVTA approval process.

Smaller manufacturers
Of course, not all motorcycles are off-the-shelf clones from mass-manufacturers. Some are produced by smaller manufacturers in much lower numbers and some are actually custom-made.

In such cases, applications must be made to the Motorcycle Single Vehicle Approval (MSVA) scheme, which, unlike the ECWVTA applies only in the UK, not across the EU.

Non-compliant motorcycles
If a consumer unknowingly buys a motorcycle from a seller that is non ECWVTA or MSVA compliant and it then causes accident and injury, he or she may be able to make a motorbike accident claim.

Furthermore, if a mass manufacturer has sold a motorcycle that is faulty and defective and injury has arisen as a consequence, a compensation claim may be launched.
