Court of Protection and catastrophic injury claims

A catastrophic injuries claim will usually be one that is made where there has been some significant loss of capacity in the claimant, whether physical or mental.

Physical catastrophic injuries
In cases where the catastrophic injuries claim has been made for an injury that is primarily physical, for example, a spinal cord injury, it is likely that the claimant will continue to possess the wherewithal to manage his or her own affairs, i.e. make financial decisions about his or her future.

In such cases, it will fall to the Court of Protection to decide whether the claimant retains the ability to make decisions, both financial and personal.

This deputy will then be charged with acting in accordance with the injured person's best interests and may be required to decide such things as how to manage the protected person's assets and how to best serve their personal welfare.
