As proposals were made for new liability criteria in respect of car accident compensation claims in 2009, a media backlash commenced where various car drivers and cyclists argued over their differing faults and legal eligibility to use the nation's roads.
It was suggested by cycling groups, as part of the government's Active Transport Plan, that whosoever was in control of the highest powered mode of transport in an injurious accident should automatically be liable and hence, their insurer should bear the costs of damage repair and personal injury compensation.
So, it would follow that if a truck hit a car, the truck driver would be at fault - if a car hit a cyclist, the driver would be at fault and if a cyclist hit a pedestrian the rider would be blamed regardless of whether the pedestrian had been texting or generally not paying attention at the time of the accident.
Naturally, the suggestions, which a Department of Transport spokesman said were not being considered by ministers, caused a road users backlash, with charges of Lycra Louts (an epithet coined by a Times Online Blogger) assaulting taxi drivers and ubiquitous 'road hogs' constantly running down any cyclist peaceably minding his own business.
However, it was personal injury solicitors who reasoned that if the proposals became law, arguments over 'power' in a car accident claim could become contentious. And if a one litre Fiat Punto drove into the back of a stationary Suburu Impreza at a set of traffic lights causing whiplash injury to the Impreza driver, should the Punto punter be able to claim for damage to his car on the blameless driver's car insurance?
And what would happen in the event of a nasty collision between pedestrians, would the fattest pavement user become at fault, or would it automatically be the male, or the youngest? It seems like an implausible proposal for many reasons.
