Car parking laws in the UK

It can be annoying trying to find a parking space when you’re in a hurry or don’t have your own driveway or allocated parking space at home. However, the alternative to driving around until you find somewhere legal to park is a parking fine of up to £60 outside of London and as much as £100 inside London. If you fail to pay your fine within the allowed time period you will normally receive an even higher fine and a possible prosecution before the magistrates courts.

Millions of parking tickets are issued in the UK every year, in fact 4.9 million tickets were issued in 2002/03, in London alone.However, as motorists we all have a responsibility to stay within the law and to follow the rules as defined by local councils and by the government. For example there are many car parking rules defined by the Road Traffic Act 1991 which are enforceable by local councils. Many of these laws apply only at certain times of the day, for example between 9 am and 5 pm. Although car parking regulations should be recognised at all times it is not an offence to park on yellow lines, it is a contravention of parking law.

Penalty Charge Notice
The following list shows examples of parking where a penalty charge notice may be issued under the Road Traffic Act.  

  • Parking in a restricted street during prescribed hour

  • Parked or loading/unloading in a restricted street where waiting and loading/unloading restrictions are in force

  • Parking without a clearly displayed pay and display ticket

  • Parking in a residents parking space without a clearly displayed residents permit

  • Parking in a permit space without displaying a valid permit

  • Parked with payment made to extend the stay beyond initial time (‘meter feeding’)

  • Parked for longer than permitted

  • Parked on a taxi rank

  • Parked wholly or partly on a cycle track

In addition to parking tickets issued by traffic wardens you can also face a ticket that is issued by a police officer, this is known as a fixed penalty notice and is enforced by the local magistrates court. You could also receive a ticket from a local authority if you are parked illegally in a local authority car park or in a pay and display bay.
