Missed diagnosis causes serious birth injury
In June 2006 we received a call from a young Norfolk woman who wanted to make a personal injury compensation claim for a birth injury she sustained the previous year.
She told us how she had experienced a fairly healthy pregnancy but was always aware there was a risk of her sustaining pre-eclampsia as it was a hereditary condition; she was carrying twins and she was overweight when she fell pregnant.
The woman made her concerns known to her doctors but she was assured that although her blood pressure readings were a little high and her urine showed traces of protein she had nothing to worry about, meaning she was not diagnosed with pre-eclampsia when she attended either of her prenatal visits.
The mother-to-be went on to suffer headaches and nausea but she was told by doctors that this was just her body's reaction to the pregnancy. However, it seems that she did in fact have pre-eclampsia and the condition was overlooked because the young woman suffered a placental disruption, where the placenta became separated from the inner wall of the uterus, just before delivery.
Thankfully, no harm came to her twin girls but the birth injury caused severe bleeding to the mother. The amount of blood she lost meant that she was very weak for several months after giving birth, making it hard to care for her babies without constant assistance. This made her very depressed as she was very much looking forward to motherhood and bonding with her children.
She contacted YouClaim as she wanted to make a medical negligence claim against the doctors who did not diagnose her condition and which subsequently lead to her sustaining the potentially fatal birth injury.
We contacted our panel of compensation solicitors and they got in touch with the mother to offer her free legal advice and talk her through the ins and outs of the personal injury compensation claim process.
Concerned that she may have to pay a fortune to make a claim against the hospital where her birth injury occurred, we told her that we work on a no win, no fee basis and that she was guaranteed to receive every penny of compensation awarded to her.
The personal injury compensation case was settled out of court when the mother was offered a settlement for an undisclosed figure which she put towards rebuilding her life with her two children.
