Cerebral palsy birth injury compensation

An eight year fight for birth injury compensation ended in relief for a Liverpool family in December 2008.  

In August 2000, the mother-of-four went for a pregnancy scan, but was sent home. Doctors had failed to check records of her previous births which would have shown them that the mother had a fibroid in her womb. Three days later the fibroid caused a massive internal bleed.

The court hearing the birth injury compensation claim ruled that if the mother had been kept in the hospital, a vital 20 minutes would have been saved in her son’s delivery time and this would have proved vital in his prognosis.

The baby boy was born with spastic quadriplegic cerebral palsy having suffered oxygen starvation in the womb. He faces a lifetime of disability and requires 24-hour-a-day care.

The judge decided to award birth injury compensation and requested that the Wirral University Teaching Hospital NHS Trust not put the family through an appeal, but the trust said it was considering appealing against the award which could be set at millions of pounds due to the level of care the youngster will need for the rest of his life.

After learning that the trust had given up plans to appeal, the mother-of-five said, “I’m so relieved, eight years is long enough.

“We were warned that an appeal could drag this out for another 18 months, and it would be painful to go through the whole thing again. This will make such a difference to [my son’s] life and that’s all I want. We have no ramps and to be able to move him from room to room or get him out in the garden will be brilliant.”

A spokesperson for the trust said, “The trust would like to place on record its regret at the serious injuries sustained by [the claimant] around the time of his birth.

“We would like to bring the claim to an end as soon as possible by agreeing the appropriate level of compensation with [the claimant's] solicitors, which will hopefully provide security for [him] and support for both him and his family going forward. The trust would like to wish them all the very best for the future.”
