Although justified birth injury compensation can help many families to adjust to the fact of their child's traumatic entry into life, and monetary damages can provide practical assistance, all would prefer that their baby had been born healthily. Now, thanks to improvements in medical science, pioneering treatments are reducing death and disability rates.
One such treatment aimed at preventing brain injury, after a baby has suffered a lack of oxygen at birth, is the use of xenon gas and body cooling in a regime developed by a professor of neonatal neuroscience at St Michael's Hospital, Bristol, and a consultant anaesthetist at Swansea University School of Medicine.
In April 2010, the first successful use of this treatment was reported after a baby delivered by emergency Caesarean section showed signs of brain injury with no pulse or independent breathing.
He was resuscitated and his breathing supported on a machine which gave him xenon gas while his body was cooled to 33.5C for the following 72 hours. The baby was then slowly warmed, enabling him to breathe on his own and feed.
Without the breakthrough treatment, it is likely that the baby had a 50% chance of suffering permanent brain damage and disability.
Although the cooling of newborn at-risk babies has begun to be adopted in a number of maternity units as a measure to reduce disability, it is not completely successful on its own. However, the addition of xenon therapy has added a further beneficial dimension which doubles the protective effect of cooling on the brain.
Out of 700,000 births each year in the UK, only a small percentage of these are likely to suffer a birth injury with a varying degree of disability.
Many of these accidents are unavoidable or have occurred despite the best efforts of health professionals to prevent them. However, some will be as a result of the actions or neglect of staff who should have had sufficient training or experience to recognise that certain circumstances may lead to a birth injury, but failed in their duty of care.
