Medical negligence compensation and pressures facing midwives

Internal NHS studies indicate that midwives are at greater risk of being named as the defendant party in a medical negligence compensation action than any other type of frontline NHS staff.

In 2010, during a Royal College of Midwives conference, John Mead, the NHS Litigation Authority's technical director, said that obstetric-related claims accounted for nearly 70% of all medical negligence compensation claimed from the NHS during 2008-09.

With midwives so often on the frontline they have many onerous responsibilities, including the job of interpreting cardiotocography (CTG) scans. Tragically, these CTG scans are frequently misread, something that can result in stillbirth, which, on average is recognized by a fatal birth injury payout of just over £50,000.

Mead comments, "A CTG scan should have the foetal heart track and a maternal track. Midwives are trained but it is relatively easy sometimes to misinterpret a track. If there is anything that looks suspicious then obstetrics help should be requested."

Experts have tried to explain the over-representation of midwives in hospital negligence claims in several ways. These include the stress placed on them by a nationwide shortage of midwifery staff, strain placed on frontline midwives by the movement of colleagues into non-clinical roles and the fact that new midwives no longer have to complete the once-requisite general nursing training.
