To gain permission to lodge his birth injury claim, his case was put before the High Court in 2008 which consented that he could take legal action against Tameside NHS Foundation Trust. The hearing was scheduled to take place in December 2009.
However, before the trial came to court, an out of court settlement of £2million was paid out by the hospital to cover the care that the claimant requires to deal with his condition.
