Excessive force leading to a birth injury compensation claim

Excessive force in the delivery of a baby is one of the forms of clinical negligence that may be cited in a birth injury claim. The adverse effects of too much force can affect both the mother and the baby involved.

Excessive force on a baby
A baby exposed to excessive force during childbirth may receive various injuries, from broken bones and bleeding from the eyes to longer-lasting conditions, such as Erb's Palsy. Click here to read about Erb's Palsy.

Excessive force on the mother
A mother subjected to excessive force can suffer musculoskeletal conditions from strains and dislocations to vaginal tears and internal complications. One mother in the UK was recently awarded almost half a million pounds in damages for excessive force that led to a rupture of her symphysis pubis (the cartilage that holds the pelvis together) during the delivery of her first child.

In both examples, a compensation claim relating to childbirth must demonstrate that the force was excessive; an unfortunate result would not be sufficient to make a claim, if the medical professionals were observing the correct methods. It is when they do not do enough to live up to those expectations, or go too far, that a claim can be made.
