It is not enough for a family to be dissatisfied with the level of maternity services provided during a birth for a birth injury claim to be made; however, what dissatisfaction with the provision of service may reveal is the kinds of practices among maternity service staff which might contribute to a culture of negligence.
In 2010 it was revealed that as many as ten new mothers a day complain about the level of maternity service they have received during the birth of their children.
Obviously, such a situation should be a major concern for everyone involved: new mothers, expectant mothers, families, midwives, doctors, obstetricians, as well as senior NHS staff and government health officials.
The disclosure unearthed a wide variety of complaints, from rude, patronising and unsympathetic staff to the kinds of incidents that might give rise to birth injury claims.
The Freedom of Information request that led to the disclosure was sent to 149 hospital trusts. However, only 111 responded. Between them, these hospital trusts recorded 2,792complaints about maternity services during 2009.
Anna Davidson, of the Birth Trauma Association, commented, "These figures and examples are not surprising given the things we hear.
"The shortage of midwives is a real problem. We hear of women left on their own to give birth or one midwife trying to cope with eight cases at a time.
"I am sure there are examples of fantastic care and dedication, but we hear from mothers who suffer nightmares, flashbacks and panic attacks.
"They say they have suffered uncontrollable pain, haven't been listened to and were not able to follow their birth plan."
