A successful birth injury compensation claim for a brachial plexus injury

In March 2007 YouClaim, the birth injury compensation specialists, received a phone call from a 36-year-old mother from Essex whose daughter sustained a brachial plexus injury during birth. The 36-year-old told us that after being in labour for more than 12 hours the delivery became rather difficult and an obstetrician decided to use forceps to help things along. However, as the baby emerged and forceps were used to pull her out her shoulders were squashed, causing a brachial plexus injury.

The serious personal injury did not become apparent for two months but as soon as a specialist diagnosed a neuroma the cause was pinpointed to a birth injury. The specialist went on to explain to the perplexed mother that a neuroma is a type of brachial plexus injury where, after the shoulder has been squashed, the nerves try to heal themselves and scar tissue grows around the injury. She was also told that because this scar tissue pressurises the injured nerve signals cannot be conducted properly to the muscles.

He warned that her little girl may be paralysed in one or more of her muscles and may either lose complete feeling and muscle control in one arm or be able to move her arms but end up with little control over her wrist or hand.

Distraught by the news, the mother asked what the prognosis was for her daughter. The specialist replied that if she didn't recover from the brachial plexus injury by 5 months, which was unlikely, that she would need nerve surgery. In the mean time, she was shown motion exercises that she could do at home with her daughter to try and help keep her joints and muscles flexible.

The baby girl did undergo nerve surgery but sustained some permanent damage which doctors said was likely to leave her with neck and shoulder pain and weakness of grip for the rest of her life.
