In November 2009, an 11 year-old-boy from Plymouth was awarded £270,795 in birth injury compensation by a judge at London's High Court after the hospital trust entrusted with his delivery admitted that the care he and his parents received during his birth were below the standard they were entitled to expect.
The settlement was agreed between the parties and approved by the court.
Shoulder dystocia birth injury
On April 11th 1998, during the boy's delivery, his shoulder became stuck behind his mother's pubic bone and it was alleged that medical staff on hand failed to employ standard manoeuvres to free him. The shoulder dystocia caused nerve damage and the boy was later diagnosed with Erb's Palsy - he suffered loss of function in his right shoulder, arm and hand.
The family's birth injury claim solicitor said that despite having had three operations on his arm and having made good recoveries after each one, he still had restricted use and significant scarring as well.
The solicitor recognised that although the boy was able to live almost fully independently, the birth injury was likely to have left him disadvantaged in the labour market and his choice of careers would be limited.
On awarding the personal injury compensation, the judge praised the boy's family for their "selfless devotion" to their son and acknowledged that the money will be held until the boy reaches 18.
The sum included around £60,000 for pain, suffering and loss of amenity, and the total amount is expected to help him with any care and assistance he may need in the future.
