Most no win, no fee claims for compensation must be commenced within three years of the date of the accident or incident which caused personal injury. However, there is no time limit for the instigation of a birth injury claim made on behalf of an injured person who "does not have mental capacity" as a direct result of injuries incurred at birth.
In 2009, a 37-year-old woman received an award of approximately £3 million as a result of her prolonged delivery in July 1972. Her permanent brain damage was diagnosed when she was a toddler and she had been cared for since birth by her parents at their home.
However, after hearing about a similar birth injury claim her parents contacted personal injury solicitors to see whether their daughter would be entitled to compensation.
Speaking about the settlement the family's medical negligence solicitor said, "Our claim against the hospital seeks to provide a financial settlement which will provide for her future.
"Her parents are aware that the time will eventually come when they won't be there to look after her and they are concerned to ensure that her future is secure."
He added that the woman requires specialist care which would make "a difference to her quality of life", but that this type of care was very costly.
At London's High Court West Midlands Strategic Health Authority admitted negligence thus enabling the damages award to be decided by the court. It will be paid in lifelong periodic payments, which are likely to amount to around £3 million.
