Make a birth injury claim for cerebral palsy

Medical errors made during the birthing process can have serious repercussions on the health of both mother and child. If such errors starve the baby of oxygen during birth, it can lead to permanent physical and mental impairments which may require extensive care and long term treatment. If hospital staff are found to be liable for the child's health problems, a birth injury claim can be made.

Cerebral Palsy is often a consequence of oxygen starvation at birth. The term means a physical condition that affects movement due to an injury to the brain. The effect it has on a sufferer varies and affects each person differently.

The way in which someone is affected is dependent on which part of the brain has been damaged. There are four main types of the condition. The first is Spastic cerebral palsy which causes some of the muscles to be tight, stiff and weak; making movement hard.

Athetoid (dyskinetic) cerebral palsy is a disruption of the control of muscles leading to spontaneous and involuntary movements.

Thirdly, Ataxic cerebral palsy causes balance problems, shaky hand and feet movements and difficulty with speech.

Lastly mixed cerebral palsy is a combination of two or more of the other types.

In 2002, a girl was born with cerebral palsy and epilepsy after she was starved of oxygen during birth. Her parents blame her condition on the negligence of NHS staff who failed to monitor her heart rate during the induced birth.

Her parents have made a compensation claim against Aneurin Bevan Health Board which covers the hospital where she was born. Similar cases have resulted in a large lump sum payment along with annual payments to cover the expense of extensive care which will be needed as the child grows up.

If you have been affected by cerebral palsy due to an injury during birth, you could be eligible to make a compensation claim.
