Birth accident claim on behalf of injured newborn

Birth accident claims cannot be made for health problems brought on by a baby's genetic make-up, since this is not the fault of doctors and midwives.

However, if a newborn is injured by an action, or inaction, from medical staff during labour, then this would constitute clinical negligence and might mean that the parents of the infant could make a compensation claim.

Very often, expectant parents are told if something appears to be wrong with their child during early scans so that they can discuss their options or prepare themselves emotionally and practically for an infant who might need more life-long care and attention than they previously thought.

Naturally, this can be stressful and upsetting for parents and the rest of the family, even when warned, but if the infant has been healthy throughout the pregnancy and negligence by hospital staff injures the child as it enters the world for the first time, the effect can be devastating on parents who have not had any time to prepare themselves mentally for something to be the matter with their infant.

Occasionally the damage is only minor and may cause the baby some discomfort until it heals, but in other cases the damage is permanent and the family are plunged into a world they had not prepared for as they prepare specialist equipment and re-think their child's future.

Making a birth accident claim
Medical staff are trained and paid to take the very best care of their patients as possible. Failure to give the highest quality of care in a hospital environment could result in death or catastrophic injury.

If you or a loved one has suffered a personal injury then you could be eligible to claim compensation for the pain, stress, and any resulting loss of earnings caused by medical negligence.

YouClaim's solicitors are sympathetic and highly trained in the field of personal injury, and if you have a case we could put you in contact with someone who has a track record of successful birth accident cases.
