Birth accident compensation may result from a stillbirth

The number of stillbirths occurring in the UK is continuing to fall but some parents may be eligible to receive birth accident compensation for their pain and suffering if the baby has died as a result of negligence or action by a medical professional.

In a survey by charity Centre for Maternal and Child Enquiries (CMACE), it was revealed that in 2008 there was a wide variation across the UK in terms of numbers of stillbirths and neonatal deaths for which there was no apparent reason, although those living in the most deprived regions are more likely to be victims and mothers who were either particularly young or old.

Following the introduction of a new system of recording causes of deaths, CMACE hoped it would be able to shed further light on the reasons for and possible prevention of stillbirths and that the figures would continue to fall.

A stillbirth is defined as occurring after the foetus is 20 weeks old, whereas a miscarriage is the term for a death prior to that.

Examination of the placenta may establish if a congenital abnormality or some aspects of the mother's health or behaviour contributed to the stillbirth but many are unexplained.

Out of about 500 annual deaths during labour or delivery, some of these occur because of problems during delivery which may be attributable to failures by NHS systems or individuals, and result in a birth-related accident.

If an obstetrician is aware of a health condition in the mother which could cause her to be at risk of stillbirth but does not treat her or take sufficient care to minimise the potential harm, this may be the basis for a personal injury case should the worst happen.

Although the majority of stillbirths cannot be avoided and medical science is, as yet, unable to explain all of them, they are traumatic for the parents and other family members involved, and there is a degree of mental suffering which a hospital or health authority should recognise if it is at fault.
