Asbestos compensation amounts
If you have contracted an asbestos related illness and it can be proven that you employer is to blame for your unlawful exposure to asbestos then you will be able to claim compensation.
The 5th Judicial Studies Board Guidelines recommend the following asbestos compensation amounts for the following asbestos illnesses.
“Most of the reported cases are of asbestos related disease but, save for asthma the brackets set out below are intended to encompass all lung disease cases irrespective of causation”
- For a young person with very serious disability where there is a probability of progressive worsening leading to premature death: £50,000 to £65,000.
- Mesothelioma (typically in an older person), lung cancer or asbestosis causing severe impairment both of function and quality of life: £40,000 to £50,000.
- Disease causing significant and worsening lung function and impairment of breath, prolonged and frequent coughing, sleep disturbance and restriction of physical activity and employment – including the more serious cases of pleural thickening: £27,500 to £40,000.
- Breathing difficulties (not disabling breathlessness) requiring fairly frequent use of an inhaler where there is an inability to tolerate smoky atmospheres; significant pleural thickening and an uncertain prognosis but already significant effect on social and working life: £16,000 to £27,500.
- Bronchitis and wheezing; pleural plaques or thickening not causing serious symptoms; little or no serious permanent effect on social or working life; varying levels of anxiety about the future: £10,500 to £16,000.
- Some slight breathlessness with no effect on working life and the likelihood of substantial and permanent recovery within a few years of the exposure to the cause or the aggravation of an existing condition: £5,250 to £10,500.
- Provisional awards for cases otherwise falling within f) or at the least serious cases within e) where the provisional award excludes any risk of malignancy or of asbestosis: £2,750 to £5,250.
The courts are not bound by theses guidelines but will generally be persuaded by them.
Special awards for asbestos claims
Special damages may be awarded to compensate for certain financial losses both in the past and those that may arise in the future. These may be but are not limited to:

- Loss of earnings
- Care, aid and equipment
- Dependency
- Funeral costs
- Bereavement damages
- Household maintenance
Sometimes the amount awarded for these special circumstances may far outweigh the original asbestos compensation amount.
Interest is also paid on general damages and special damages. Interest on general damages is payable at 2% per year and on special damages it is 3.5% per year.
Sometimes provisional damages are also awarded when there is a chance that at some time in the future health could deteriorate further as a result of asbestos exposure.
